These Terms govern your use of the Thirsty Cellar app and the Thirsty Cunt website (thirstyc.com). By using either, you agree to these Terms. If you don't agree, please don't use the services.

1. Who We Are

The Thirsty Cellar app and Thirsty Cunt brand (the "Services") are operated by:

Catherine Gignac, sole proprietor, doing business as Thirsty Cunt.
Based in Toronto, Ontario, Canada.

In these Terms, "we," "our," and "us" refer to Thirsty Cunt. "You" refers to anyone using the app or website.

2. Eligibility

The Services are intended for users 18 years of age or older. By using the Services, you confirm that:

• You are at least 18 years old (or the legal drinking age in your jurisdiction, whichever is higher).
• You have the legal capacity to enter into these Terms.
• You are not prohibited by law from using wine-related services.

3. Description of the Services

3.1 Thirsty Cellar (the App)

A mobile application available on iOS that allows users to catalog their wine collection, track aging, scan wine labels, take tasting notes, and manage their personal cellar.

3.2 Thirsty Cunt (the Website and Brand)

A wine lifestyle brand encompassing the website (thirstyc.com), an editorial Substack newsletter, social media presence (@thirstyc.official), and live tasting events in Toronto and Montréal (planned).

4. Accounts

4.1 Account Creation

To use the full features of the app, you may need to create an account. You can do so using:

• An email address and password, or
• Sign in with Apple or Google.

4.2 Your Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying us immediately at hello@thirstyc.com if you suspect unauthorized use.
• Providing accurate, current information.

5. Subscriptions & In-App Purchases

5.1 Free Tier

Thirsty Cellar is available to download and use at no cost, with a free tier offering core features.

5.2 Premium Subscription

We may offer paid subscriptions (monthly or annual) and one-time in-app purchases that unlock additional features. Current pricing is displayed in the app at the time of purchase.

5.3 Billing through Apple

All purchases made through the app are processed by Apple via the App Store, and are subject to Apple's terms and conditions. By making a purchase, you also agree to Apple's Media Services Terms.

5.4 Auto-Renewal

Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can manage and cancel subscriptions through your Apple ID account settings on your device.

5.5 Refunds

All refund requests are handled by Apple, in accordance with their policies. We are not able to issue refunds directly. You can request a refund at reportaproblem.apple.com.

6. Wine Tastings (Future Service)

We plan to offer live wine tasting events in Toronto and Montréal. When this service launches, additional terms will apply, including:

• Ticket purchase and payment terms.
• Cancellation and refund policy.
• Code of conduct for events.
• Health and safety requirements.

Until then, joining a tasting waitlist is free and incurs no obligation.

7. User Content

7.1 What You Own

You retain ownership of any content you create within the app, including wine entries, tasting notes, photos of labels, and any other personal data.

7.2 License You Grant Us

You grant us a limited, non-exclusive, royalty-free license to store, process, and display your content solely as necessary to provide the Services to you. We do not claim ownership of your wine cellar data or use it for any commercial purpose unrelated to providing the app.

7.3 Acceptable Content

You agree not to upload content that is illegal, infringes on others' rights, contains malware, or violates these Terms.

8. Responsible Use

You agree not to:

• Use the Services for any unlawful purpose or to promote excessive alcohol consumption.
• Reverse engineer, decompile, or attempt to extract the source code of the app.
• Scrape, harvest, or extract data from the Services using automated tools.
• Use the Services in ways that disrupt, damage, or impair their functioning.
• Impersonate any person or misrepresent your affiliation with anyone.
• Resell, sublicense, or commercially exploit any part of the Services without our written permission.

9. Intellectual Property

All content, design, code, logos, trademarks, and branding belonging to Thirsty Cunt and Thirsty Cellar are our exclusive property, protected by Canadian and international copyright and trademark laws. You may not use, reproduce, or distribute any of our brand materials without prior written consent.

The name "Thirsty Cunt," the wine glass logo, and the "tc" monogram are trademarks of Catherine Gignac.

10. Wine Information Disclaimer

The wine information presented in the app, the Substack, and the website (including label recognition results, tasting notes, region descriptions, and recommendations) is provided for informational and educational purposes only. It does not constitute professional advice. We do not guarantee the accuracy, completeness, or reliability of any wine-related information.

11. Limitation of Liability

To the maximum extent permitted by law:

• The Services are provided "as is" and "as available," without warranties of any kind.
• We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services.
• Our total liability to you for any claim arising out of or relating to these Terms or the Services is limited to the greater of (a) the amount you paid us in the 12 months prior to the claim, or (b) CAD 100.

Some jurisdictions don't allow the exclusion of certain warranties or limitation of certain damages. In those jurisdictions, the above limitations apply to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify and hold Catherine Gignac and Thirsty Cunt harmless from any claims, losses, damages, or expenses (including reasonable legal fees) arising out of your violation of these Terms, your misuse of the Services, or your violation of any third-party rights.

13. Apple-Specific Terms (iOS Users)

If you downloaded the app from the Apple App Store, the following additional terms apply:

• These Terms are between you and Thirsty Cunt only, not with Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to provide maintenance or support for the app.
• Apple is not responsible for addressing any claims you have related to the app.
• In case of any third-party claim that the app infringes intellectual property rights, we (not Apple) are responsible for handling such claims.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them.

14. Termination

14.1 By You

You may stop using the Services at any time. You can delete your account directly in the app (Profile → Settings → Delete My Account) or by emailing hello@thirstyc.com.

14.2 By Us

We reserve the right to suspend or terminate your access to the Services if you violate these Terms or engage in conduct we determine, in our reasonable judgment, to be harmful to other users, us, or third parties.

15. Privacy

Your privacy is important to us. How we collect, use, and protect your personal data is described in our Privacy Policy. You can exercise your data rights at any time via Your Privacy Choices.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. When we make significant changes, we will notify you via the app, by email, or by posting a notice on the website at least 30 days before the changes take effect. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services will be submitted to the exclusive jurisdiction of the courts of the City of Toronto, Province of Ontario, Canada.

18. Miscellaneous

• Entire agreement: These Terms, together with our Privacy Policy and Privacy Choices, constitute the entire agreement between you and us regarding the Services.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
• No waiver: Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
• Assignment: You may not transfer or assign these Terms. We may transfer them to a successor or affiliate.
